Oklahoma payroll taxes for employers (2026)

The Oklahoma Employment Security Commission (OESC) charges new employers 1.5% on the first $25,000 of each worker's 2026 wages, and Oklahoma withholds state income tax with a top rate cut to 4.50% for 2026 (OESC 2026 Important Numbers sheet, plus a USDA National Finance Center payroll bulletin of March 13, 2026 and Bloomberg Tax for the income tax rate, checked October 2026). The odd piece is the state minimum wage law, which has two tiers: $7.25 for employers with 10 or more full-time employees at one location or gross sales over $100,000, and $2.00 for other employers that federal law does not cover.

Oklahoma payroll details that differ from other states
Most businesses never use the $2.00 tier, because any employer covered by the federal Fair Labor Standards Act owes $7.25 regardless of the state figure. For servers and bartenders, $2.13 in cash plus a $5.12 tip credit reaches the $7.25 floor. If you run a restaurant, our restaurant payroll guide covers tip credits and reporting.
- Lower withholding for 2026: for single filers, the annual brackets are 0% up to $10,100, 2.50% up to $11,250, 3.50% up to $13,550 and 4.50% above; married thresholds are doubled. We took these from a federal payroll bulletin (USDA NFC, March 13, 2026) and Bloomberg Tax, because the Oklahoma Tax Commission's OW-2 2026 PDF would not load for us. Neither source gave a bonus rate.
- One new employer rate for everyone: OESC lists 1.5% for new accounts and no separate construction rate. Once you have a claims history, OESC can assign anything between 0.2% and 5.8%. The 2026 sheet also shows Conditional Factor A and a State Factor of 30%, and lists no surcharge.
- Twice-monthly paydays: Oklahoma expects two paydays a month on a fixed schedule for most staff, and a check that runs more than 3 days late breaks the rule.
- Final pay on the next payday: the Oklahoma Department of Labor puts the deadline at the next scheduled payday, for quits and firings alike.
- Workers comp for most employers: the Workers' Compensation Commission employer guide exempts employers with 5 or fewer employees who are all related by blood or marriage, agricultural or horticultural payroll under $100,000, and sole proprietors and owners of 10% or more (who can elect coverage). Coverage comes from a private insurer, self-insurance or a group plan; the state has no monopolistic fund. The guide is based on laws in effect in 2015, so check for later changes.
Oklahoma does not appear to levy a paid leave or disability deduction, and our research found no city or county wage tax. We could not confirm either point against an official list.

How to register as an employer in Oklahoma
- Start with an EIN from the IRS.
- Open your OESC unemployment account. OESC's employer page sends you to EZ Tax Express (eztaxexpress.oesc.ok.gov), though it never states that new accounts are created there; phone OESC if you see no sign-up option.
- Add a withholding account with the Oklahoma Tax Commission (oklahoma.gov/tax/businesses/withholding.html).
- Report new hires to OESC within 20 days of the start date.
- Buy a workers comp policy unless one of the listed exemptions fits you.
- Schedule two or more paydays each month.

A bad claims record could push you to 5.8%, which means $1,450.00 of SUTA and $5,317.00 overall. From the worker's pay you take $3,825.00 of FICA plus income tax, and most of a $50,000 salary is taxed in Oklahoma's 4.50% bracket. Enter a different salary below, or line up the $25,000 base against Texas, Kansas and the rest on our SUTA rates for 2026 page.
Payroll services and PEOs for Oklahoma employers
The 2026 rate cut is the thing to check with any provider: withholding should reflect the 4.50% top rate, not the old 4.75%. If you pay tipped staff, make sure the system applies the $2.13 cash wage only when tips cover the gap to $7.25.
See our payroll software rankings and the fees behind each price in what payroll costs. PEOs fold workers comp and health plans into one invoice; compare them on the PEO rankings and the PEO pricing page. For staff in nearby states, see Texas, Kansas and Arkansas, and pay floors on the 2026 minimum wage table.
